1. Acceptance of Terms

Welcome to SimRacing Arena. These Terms of Service ("Terms") govern your access to and use of our website, facilities, services, and any related offerings (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our Services. We reserve the right to modify these Terms at any time. Your continued use of the Services following any changes constitutes acceptance of those changes.

2. Eligibility

To use our Services, you must:

• Be at least 18 years of age, OR be at least 13 years of age with parental or guardian consent and supervision
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Services under applicable laws
• Comply with all applicable laws and regulations

Minors under 18 must have a parent or legal guardian present during their visit and the parent/guardian must accept these Terms on their behalf.

3. Account Registration

Some features of our Services require you to create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Bookings and Reservations

4.1 Making Bookings

All bookings are subject to availability. A booking is confirmed only after you receive a confirmation email from us. We reserve the right to refuse or cancel any booking at our discretion.

4.2 Pricing

All prices are listed in US Dollars and are subject to change without notice. Prices displayed at the time of booking will be honored for that booking. Any applicable taxes will be added to your total.

4.3 Payment

Payment is required at the time of booking unless otherwise arranged. We accept major credit cards and other payment methods as displayed on our website. You agree to pay all charges incurred under your account.

4.4 Cancellations and Refunds

• 48+ hours before session: Full refund
• 24-48 hours before session: 50% refund
• Less than 24 hours: No refund (credit may be offered at our discretion)
• No-shows: No refund

To cancel a booking, please contact us via email or phone. Refunds will be processed within 5-10 business days to the original payment method.

4.5 Rescheduling

Bookings may be rescheduled free of charge if requested at least 24 hours in advance, subject to availability.

5. Facility Rules and Conduct

When using our facilities, you agree to:

• Follow all posted rules and staff instructions
• Treat equipment with care and respect
• Behave in a respectful manner towards staff and other guests
• Not consume alcohol excessively or use illegal substances
• Not bring outside food or beverages unless authorized
• Not engage in any dangerous or disruptive behavior
• Wear appropriate attire (closed-toe shoes recommended)
• Report any equipment issues or safety concerns to staff immediately

We reserve the right to refuse service or remove any person who violates these rules without refund.

6. Equipment Use

Our racing simulators and equipment are provided for your use during your booked session. You agree to:

• Use equipment only as intended and instructed
• Not modify, disassemble, or tamper with any equipment
• Report any malfunctions or damage immediately
• Not install personal software or peripherals without authorization
• Follow proper procedures for adjusting seats, pedals, and controls

You may be held liable for any damage to equipment caused by misuse, negligence, or intentional acts.

7. Leagues and Competitions

7.1 Participation

Participation in leagues and competitions is subject to separate rules and regulations that will be provided upon registration. Entry fees, if applicable, are non-refundable unless the event is cancelled by us.

7.2 Fair Play

All participants must compete fairly and honestly. Cheating, exploiting bugs, or unsportsmanlike conduct may result in disqualification and possible ban from future events.

7.3 Prizes

Prizes, if offered, are non-transferable and have no cash alternative unless stated otherwise. Winners may be required to provide identification and complete necessary tax documentation.

8. Intellectual Property

All content on our website and at our facilities, including but not limited to logos, text, graphics, images, software, and designs, is the property of SimRacing Arena or our licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works of any content without our express written permission.

9. Assumption of Risk and Liability Waiver

9.1 Assumption of Risk

You acknowledge that sim racing activities, while not involving actual vehicles, may pose certain risks including but not limited to motion sickness, eye strain, and repetitive strain injuries. By using our Services, you voluntarily assume these risks.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMRACING ARENA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

Our total liability for any claims arising from your use of our Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

9.3 Medical Conditions

If you have any medical conditions that may be affected by simulator use (epilepsy, heart conditions, motion sensitivity, pregnancy, etc.), please consult your physician before using our Services and notify our staff.

10. Indemnification

You agree to indemnify, defend, and hold harmless SimRacing Arena and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of a third party
• Your negligent or wrongful conduct

11. Photography and Media

We may take photographs or videos at our facilities for promotional purposes. By visiting our facilities, you consent to being photographed or recorded and to the use of such media for marketing and promotional materials.

If you do not wish to be photographed, please inform our staff upon arrival. Personal photography and videos for non-commercial use are permitted.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, power outages, or equipment failures.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the state where the applicable SimRacing Arena facility is located, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
